Terms of Service

1. Your account

You must be at least 18 years old and able to enter a binding contract. You are responsible for activity under your account and for keeping your login credentials secure. Notify us immediately of any unauthorized use.

2. Subscriptions, trials, and billing

• Paid plans renew automatically each billing period (monthly or annual) until cancelled.
• The Studio plan includes a 30-day free trial. No credit card is required to start the trial. After 30 days you may subscribe or downgrade; the Service may become read-only until a plan is chosen.
• Annual plans are billed up front and discounted relative to month-to-month pricing.
• Fees are non-refundable except where required by law. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
• We may change pricing for future billing periods with at least 30 days' notice.

3. Acceptable use

You agree not to:

• Use the Service to store or distribute unlawful, infringing, or harmful content.
• Upload content depicting minors in sexual contexts, non-consensual imagery, or material that violates the privacy or publicity rights of others.
• Attempt to reverse engineer, scrape, or interfere with the Service or other users.
• Resell or sublicense the Service without our written permission.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

4. Your content

You retain all rights to the photos, files, and information you upload ("Your Content"). You grant PixPrism a limited, worldwide, royalty-free license to host, store, transmit, and display Your Content solely as needed to operate the Service for you and your clients (for example, generating gallery share links and thumbnails). We will not use Your Content for marketing or AI training without your explicit written consent.

You represent that you own or have the rights to Your Content and to grant the license above, and that Your Content does not violate any third-party rights.

5. Client data and your obligations

When you collect client contact details, booking information, or media through the Service, you are the data controller. You are responsible for having a lawful basis to process that data, providing your clients with required notices, and honoring their privacy rights. PixPrism acts as a data processor on your behalf.

6. Storage limits and fair use

Each plan includes a stated storage allowance and limits on active projects. We may ask you to upgrade or archive content if you exceed those limits. We may also apply reasonable rate limits to protect the Service for all users.

7. Service availability

We work hard to keep PixPrism available and fast, but we do not guarantee uninterrupted access. Planned maintenance is announced in advance when possible. The Service is provided "as is" without warranties of any kind, express or implied.

8. Limitation of liability

To the maximum extent permitted by law, PixPrism's total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose or (b) USD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data.

9. Indemnification

You will indemnify and hold PixPrism and its team harmless from any claim arising out of Your Content, your use of the Service, or your violation of these Terms.

10. Termination

You may delete your account at any time from settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, your right to use the Service ends; data is retained or deleted in accordance with our Privacy Policy.

11. Changes

We may update these Terms from time to time. Material changes will be announced at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which PixPrism is registered, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located there, unless a mandatory consumer law in your country provides otherwise.
